How Buying a Home in Spain Works: The Process, Step by Step

Buying a home in Spain as an American is straightforward in principle (there are no restrictions on foreign buyers), but the process, the people involved and the costs differ from a U.S. purchase. Here is the sequence, in plain English.

1. Decide what the home is for

A second home, a future retirement home, a full move: the purpose shapes the area, the property type and the timing. It also shapes practical choices such as whether you'll need a mortgage or a currency transfer.

2. Get the basics in place

You'll need an NIE (the foreigner identification number) to buy, and a Spanish bank account for the transaction and later for utilities and taxes. Both can be arranged before you start viewing seriously. If you'll need financing, speak to a lender early: Spanish banks do lend to non-residents, usually for a lower share of the price than to residents, and the process takes time.

3. Choose the area, then the property

Spend time comparing areas with local knowledge before comparing listings. Then narrow the property search: type, condition, orientation, community fees for apartments, what the neighborhood is like at different hours and seasons. Viewings (in person, or with someone you trust on the ground) matter more here than online photos.

4. Appoint your own lawyer

An independent lawyer who represents you (not the seller or the agent) checks the title, debts, permits and the building's legal status, and guides you through the contracts. This is the single most important professional in the process.

5. Reservation and private contract

Once you agree a price, there's typically a reservation agreement with a small deposit that takes the property off the market, followed by a private purchase contract (*contrato de arras*) with a larger deposit (commonly around 10%) and a completion date. Penalties for pulling out apply to both sides, so the legal checks should be done before you sign.

6. Due diligence and financing

Between the private contract and completion your lawyer completes the checks, a surveyor can inspect the property if you want one, and the mortgage and any currency transfer are finalized. Non-resident buyers often use a currency specialist to move dollars to euros at the right moment.

7. Completion before a notary

The sale is signed before a Spanish notary, the balance is paid, and you receive the keys. The deed is then registered in the Land Registry in your name. Your lawyer normally handles the post-completion registrations and tax filings.

What to budget beyond the price

Purchase taxes and fees vary by region and by whether the home is new or resale. As a working rule, buyers set aside a meaningful percentage on top of the price for transfer tax or VAT, notary and registry fees and legal costs. Your lawyer will give you the exact figures for the region and property you choose. After purchase, expect an annual local property tax, community fees for apartments, and, if you don't live in Spain, a non-resident tax return each year.
